Abstract

Jurisprudence of education, as a newly emerging knowledge, is faced with basic questions that failure to answer these questions will make the basis of formation and development of this knowledge difficult. The basic question is, what kind of influence do the collection of Shariah rulings have on the education process as a product of jurisprudence? If these types are identified, the way to enter the jurisprudence of education will be opened. Thinkers in the field of Islamic education have made references to this influence in their works; But the dispersion and lack of concentration in the investigation of these effects has caused the lack of an appropriate and comprehensive answer to this question. Therefore, in a descriptive-analytical way, this research has extracted and compared the various effects of legislation and compliance with Sharia rulings on the education process from the works of Muslim educational thinkers and has shown that in addition to the role of compliance with Sharia rulings in education, Sharia rulings in other levels It also has educational effects, and comprehensiveness and legalization of rulings as much as possible, revelation of rulings in the language of the people and in a gradual manner that is accompanied by the expression of their philosophy and encouragement and rebuke, and the conditions of establishing rulings in Islamic governance, all have different effects on the realization of goals. and facilitating the education process.
